Definitions

For the Purposes of These Terms and Conditions:
  • Country refers to the United States

  • Company ("the Company", "We", "Us" or "Our") refers to The Light Brigade, Inc., 835 Central Ave North, Suite D-132, Kent, WA 98032.

  • Device means any device that can access the Internet such as a computer, a smartphone, or a digital tablet.

  • The website refers to Light Brigade, accessible from https://www.lightbrigade.com/

  • (You) meaning the individual accessing or using the internet, or the company, or other legal entity on behalf of which such individual is accessing or using the Website, as applicable.

Acknowledgements

These are the Terms and Conditions governing the use of this Website and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding its use. Your access to and use of the Website is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and others who access or use the Website. Your access to and use of the Website is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Website.
 

Changes to these Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is made, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

 

Instructor-Led Training (Online)
  • All orders will be invoiced and credit cards will be processed on the first day of class.

  • Rescheduling requests will be accommodated whenever possible and at the discretion of The Light Brigade, Inc. Ref policy below. Substitute attendees are allowed.

  • Registrations placed 5 business days or less prior to class start date may be subject to additional $150 administration fee to cover separate admin and materials freight charges.

  • If for any reason the course is canceled, The Light Brigade Inc.'s liability is limited to the return of any previously charged course fees.

  • Terms of Payment: NET 30 on open account USD Only.

  • Cancellation less Than 30 Days Prior to Class 50% of Base Price.


Instructor-Led Training (On-site)

Cancellation Policy
  • Cancellation 21+ Days Prior to Class No Cancellation Fee.

  • Cancellation 20-14 Days Prior to Class 20% Cancellation Fee.

  • Cancellation Less Than 13 Days Prior to Class 100% Cancellation Fee

  • Cancellation Without Notice No Refunds.

On-site Instructor-Led Training (Customer Location)
  • Orders will be invoiced on the first day of class.

  • Terms of Payment: NET 30 on open account USD Only.

  • The final student count commitment is due 3 weeks prior to the start of class.

Cancellation Policy

Cancel Less Than 30 Days Prior to Class 50% of Base Price.

Student Policy
  • Cancel Less Than 14 Days Prior to Class 20% Per Student.

  • Cancellation Without Notice No Refunds.

  • Added Less Than 4 Days Prior to Class$250 Expedite Fee.
     

Reschedule Policy
  • Reschedule 30+ Days Prior to Class start, No Rescheduling Fee*

  • Reschedule 29-14 Days Prior to Class start, 20% Rescheduling Fee*

  • Reschedule 13 or Less Days Prior to Class start 50% Rescheduling Fee*

  • The rescheduling fee is in addition to the base price and the class must be rescheduled within 90 days of the original date*
     

Online Training
  • Course license is limited to one user for the term stated on the subscription.

  • Substitute attendees will be allowed up until the course materials have been accessed.

  • No refund will be given once course materials have been accessed.
     

Product Sales
  • Terms of payment: NET 30 days on approved credit.

  • All shipments are F.O.B. Light Brigade's facility, Kent, Washington, via UPS ground.

  • All sales are in U.S. funds.

  • No return of goods without prior approval.

  • A 25% restocking charge will be added to all returned goods.

  • Goods are deemed accepted unless the buyer notifies Light Brigade of damage or defect within 5 days of receipt of goods.

  • Any claims for shortages must be made in writing within 10 days from the date of delivery.

  • Our minimum accepted Sales Order value is $250. We reserve the right to charge a $75 small order processing charge for any Sales order under this value.

Used Equipment Sales

  • All goods are purchased by the purchaser “as is” and “with all faults”. Purchaser understands that the Goods described herein have been previously used.

  • Seller makes no representation or warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, warranty against infringement of intellectual property rights of a third party or any other matter with respect to the goods or services.

  • LIMITATION OF LIABILITY. To the fullest extent permitted by law, in no event shall Seller be liable for indirect, incidental, special, exemplary, consequential or punitive damages, or for any related expenses, including, but not limited to, cost of labor, shipping costs, downtime, removal, reinstallation, or lost profits. In no event shall Seller’s aggregate liability arising out of or related to the sale of Goods OR services or the Terms exceed the purchase price of the Goods or services related to which such liability arises.

  • Seller strongly recommends that purchaser conduct an on-site inspection of the goods sold hereunder prior to purchase. Seller shall not be responsible for the consequences of purchaser’s failure to inspect the goods or for any inaccuracies, insufficiencies, or omissions in such descriptions, samples and/or specifications.

  • Seller is not obligated to do any repair work upon or modifications to the Goods prior to sale or delivery. Any repair work or modifications performed by Seller on the Goods prior to sale shall be performed as a result of the sole request of Purchaser using designs and instructions provided by Purchaser. Accordingly, Seller shall not be liable for any alleged damages caused by or resulting from the repairs or modifications. Seller gives no warranty, express or implied, as to the quality, merchantability, workmanship or any other matter with respect to any such repairs or modifications.
